Superior court decisions

The following decisions were reached in Lenoir County superior court in January 2012. The presiding judge was the Hon. Paul Jones. Matters may be resolved as the result of a guilty plea or dismissal negotiated with the district attorney without a trial. Matters may also be resolved as the result of a trial during which the judge dismisses the case for insufficient evidence or renders a verdict of innocence or guilt. In any case in which a guilty plea or verdict is entered, sentencing is determined by the judge:

 

Lee Grimes Jr., worthless check, pleaded no contest, sentenced to 4-5 months in the Department of Correction, suspended to 24 months supervised probation.

Elwood Gray, possession with intent to sell/deliver schedule VI, guilty, sentenced to 4-5 months in the Department of Correction, suspended to 24 months supervised probation.

Michael Mills, larceny, guilty, sentenced to 45 days in the Lenoir County jail, suspended to 12 months supervised probation.

Kevin Smith, possession of methamphetmine, guilty, sentenced to 6-8 months in the Department of Correction, suspended to 24 months supervised probation.

Alvin Pratt, common law robbery, guilty, sentenced to 14-17 months in the Department of Correction.

Davan Shackleford, possession of stolen goods, guilty, sentenced to 5-6 months in the Department of Correction, suspended to 30 months supervised probation.

Kenno Smith, assault on a female, pleaded no contest, sentenced to 75 days in the Lenoir County jail, suspended to 18 months supervised probation.

Eula Herring, traffic opium by possession (substantially assist), guilty (court finds = substantially assist), sentenced to 15-18 months in the Department of Correction, suspended to 60 months supervised probation.

Roland Tucker, possess cocaine, guilty, sentenced to 6-8 months in the Department of Correction.

Venzetti Ham, possession with intent to sell/distribute cocaine/habitual felon, guilty, sentenced to 50-69 months in the Department of Corrections.

Montez Nelson, possession with intent to sell/distribute cocaine/possession of firearm by felon, guilty, issued prayer for judgement.

Rexford Smith, two counts habitual driving while impaired, guilty, sentenced to 16-20 months each. Assault on a female, guilty, sentenced to 60 days in the Department of Correction.

Ricardo Contrease, obstruction of justice, guilty, sentenced to 45 days in the Lenoir County jail.
